The 12-week rule
Immigration Service Delivery (ISD) publishes a notice to employers for exactly this situation. If your IRP card expires while your renewal is still in the queue, you can stay and keep working on the conditions of your current card for up to 12 weeks after the expiry date, as long as:
- you applied to renew before your card expired (this includes applying to change stamp),
- you uploaded all the required documents with your application, and
- you hold a valid, in-date employment permit, or a permission that doesn’t need one.
The cover ends sooner if ISD finishes your renewal first: from then on, your approval email is your proof.
| You applied before your card expired | You applied after it expired, or haven’t applied | |
|---|---|---|
| Up to 12 weeks after expiry | Keep working, on your current card’s conditions. | Not covered. ISD treats you as out of permission. |
| More than 12 weeks after expiry | The notice no longer covers you. Contact ISD and get advice. | Not covered. |
Check your cover
Enter your dates to see whether the 12 weeks apply to you, when they end, and what your employer needs to see. If you’re covered, you can copy a short note to send them.

What your employer needs to see
Your employer will want proof that you can still work. While your card is expired, give them:
- Your renewal acknowledgement email. ISD sends it when you apply. It shows your application number (starting with OREG) and the date you applied, which is what proves you applied in time.
- Your expired IRP card, so they can see the date it expired and the stamp you’re on.
- Your valid employment permit, if your job is based on one.
- ISD’s notice to employers, which sets out the 12-week rule in ISD’s own words.
When your renewal is approved, forward the approval email. ISD says it can be used as proof of registration until the new card arrives, which can take up to 15 business days.
Your current card’s conditions, not the new ones
While you wait, you’re on the existing conditions of your current card. That matters if you’ve applied to change stamp:
- Stamp 2 to Stamp 1G: you stay on student conditions, up to 20 hours a week in term and 40 in the holidays, until the Stamp 1G is approved. Then you can work full time.
- Stamp 1 to Stamp 4 (upgrade): this one is different. If you were eligible for the upgrade when you applied and asked to renew on Stamp 4 conditions, ISD’s notice says you’re covered without needing an employment permit while you wait.
- Stamp 3 or another stamp that doesn’t allow work: the notice doesn’t add work rights. You stay on the same conditions.
If you work on an employment permit
Two separate deadlines apply: your employment permit and your IRP card.
- Renew the permit first. ISD refuses IRP renewals based on an employment permit unless a valid, in-date permit was uploaded with the application.
- The permit has its own window. The Department of Enterprise accepts permit renewals in the 4 months before the permit expires, or in the month after. It says that once a renewal is submitted within that period, you can keep working while it’s processed.
- The 12-week IRP cover needs a valid permit. It only applies if you have a valid, in-date employment permit (or a permission that doesn’t need one) and it was uploaded with your renewal.
How long people are waiting right now
ISD works through renewals in the order they arrive, separately for each stamp. If the wait is longer than the time between applying and your expiry date, your card will expire before your turn comes, and you’ll be relying on the 12 weeks.
| Stamp | Waiting in ISD's queue | Card by post | Total |
|---|---|---|---|
| Stamp 1 and 1H | 7.4 weeks | 3 weeks | 10.4 weeks |
| Stamp 1G | 8.4 weeks | 3 weeks | 11.4 weeks |
| Stamp 2, 2A and 1A | 8.4 weeks | 3 weeks | 11.4 weeks |
| Stamp 4 | 5.1 weeks | 3 weeks | 8.1 weeks |
| All other stamps | 3.4 weeks | 3 weeks | 6.4 weeks |
- Waiting in ISD's queue
- New card by post (up to 15 business days)
- The 12 weeks you have between the window opening and expiry
If you’re past the 12 weeks
The notice to employers covers a maximum of 12 weeks after your card expires. During summer 2026, an interim measure let people who applied in time keep working until 31 August 2026, however long they’d been waiting. That measure has ended, and the 12-week limit applies again.
If your 12 weeks have run out and ISD still hasn’t decided:
- Contact ISD through the Customer Service Portal, quoting your OREG number.
- Make sure you’ve answered any request for further documents. If you don’t reply within 14 days, ISD refuses and closes the application.
- Talk to your employer, and get free, independent advice (see below).
If you applied after your card expired
The 12-week cover only applies if you applied before your card expired. ISD’s notice is clear that if your permission expired before you applied, you’re considered out of permission, and not allowed to remain or work in Ireland.
Common mix-ups
Next time: apply on day one
The simplest way to avoid all of this is to apply as soon as your renewal window opens, 12 weeks before your card expires. ISD renews your permission from your current expiry date, so applying early costs you nothing. Find your date with the renewal planner.
Common questions
Can I keep working after my IRP card expires?
Usually, for up to 12 weeks after the expiry date, on the conditions of your current card. You must have applied to renew before the card expired, uploaded all the required documents, and hold a valid employment permit or a permission that doesn't need one.
What should I show my employer?
Your renewal acknowledgement email, which shows your OREG application number and the date you applied, along with your expired IRP card and ISD's notice to employers. If you work on an employment permit, your valid permit too. Once your renewal is approved, send them the approval email.
What if I applied after my card expired?
The 12-week cover doesn't apply. ISD says that if your permission expired before you applied, you're out of permission and not allowed to remain or work in Ireland. Get free, independent advice straight away and contact ISD through its Customer Service Portal.
What happens after 12 weeks if ISD still hasn't decided?
The notice to employers covers a maximum of 12 weeks after expiry. A summer 2026 measure that lifted this limit ended on 31 August 2026. Contact ISD through the Customer Service Portal with your OREG number, and get independent advice.
I've applied to move from Stamp 2 to Stamp 1G. Can I work full time now?
Not yet. While you wait, you stay on the conditions of your current card, which for Stamp 2 means up to 20 hours a week in term and 40 in the holidays. The Stamp 1G conditions start once ISD approves the change.
I'm on Stamp 1 and applied for a Stamp 4 upgrade. Do I still need my employment permit?
Not to keep working while you wait, if you were eligible for the upgrade when you applied and applied to renew on Stamp 4 conditions. ISD's notice says you're covered without an employment permit.
My employment permit is also up for renewal. Which do I renew first?
The employment permit. ISD refuses IRP renewals based on an employment permit unless a valid, in-date permit is uploaded. The Department of Enterprise accepts permit renewals in the 4 months before the permit expires, or the month after, and says you can keep working while a renewal made in that period is processed.
Does the approval email count as proof I can work?
Yes. ISD says the approval email can be used as proof of registration while you wait for the new card, which can take up to 15 business days to arrive by post.
